For Customers in the European Economic Area and the United Kingdom

In addition to “Handling of Personal Information,” this section applies to customers in the European Economic Area (EEA) and the United Kingdom (UK.)

Legal Basis

SMM handles personal data on the following legal basis.
(a)Contract:
Where SMM needs to handle your personal data in order to perform a contract it has entered into with you.
(b)Legitimate interests:
Where handing your personal data is necessary for the purposes of the legitimate interests pursued by SMM or a third party (e.g., responding to inquiries) and where such interests are not overridden by your interests or fundamental rights. (c)Consent:
Where SMM has received your consent for handling your personal data. For the avoidance of doubt, the withdrawal of consent by you will not affect the lawfulness of the handling that was performed based on such consent before its withdrawal.
(d)Legal obligations:
Where the handling of your personal data is obligated under tax and other laws applicable to SMM.

Disclosure of Your Personal Data

SMM may share your personal data with the following categories of recipients.
(a)SMM’s domestic and overseas related companies
(b)Service providers providing IT services, etc.
(c)SMM employees
In addition, SMM may disclose your personal data to public institutions, etc. in cases where such disclosure is required by applicable law or where it is necessary for the settlement of disputes. In cases where SMM business is succeeded due to organizational restructuring, such as a merger or corporate split-up, transfer of business, or otherwise, SMM may disclose your personal data to a third party succeeding to its business.

Transfer of Your Personal Data Outside the EEA or the UK

Your personal data may be transferred to a third party outside the EEA or the UK and may be stored by such third party. If SMM transfers your personal data to a third party outside the EEA or the UK, it ensures (a) or (b) below.
(a)The region to which the transfer will be made has been recognized by the European Commission or designated by the government of the UK as ensuring an adequate level of protection for the rights and freedoms that you possess in respect of your personal data; or
(b)The third party to whom the data will be transferred has concluded with SMM standard contractual clauses approved by the European Commission or other contracts for the transfer of personal data as required by applicable data protection laws and regulations.

Retention Period

Personal data acquired by SMM are retained until their retention periods specified by SMM have elapsed unless required by law to retain them for a longer period of time. SMM shall specify retention periods of personal data according to the category and purposes of use thereof and to the extent necessary for such purposes. Your Rights

You have the following legal rights regarding personal data held by SMM with respect to you.
(a)The right to obtain information regarding the processing of your personal data and the right to access the personal data held by SMM with respect to you.
(b)The right to request that SMM correct any inaccuracy or incompleteness in your personal data.
(c)The right to request that SMM erase your personal data in certain circumstances. They include, but are not limited to, the following circumstances.
(i)Where SMM no longer needs to retain your personal data in light of the purpose for which it collected such personal data.
(ii)Where SMM is only authorized to process your personal data based on your consent and where you have withdrawn consent.
(iii)Where you object to the processing of your personal data that SMM performs based on its legitimate interests and such legitimate interests do not override your own interests, rights, or freedoms.
(d)The right to request that SMM restrict its processing of your personal data in certain circumstances. They include, but are not limited to, the following circumstances.
(i)Where you challenge the accuracy of your personal data (only for the period of time required for SMM to verify its accuracy).
(ii)Where SMM no longer needs to use your personal data, except for the establishment, exercise, or defense of legal claims.
(iii)Where you object to the processing of your personal data that SMM performs based on its legitimate interests (only for the period of time required to determine whether or not SMM’s legitimate interests override your own interests, rights, and freedoms).
(e)The right to object to SMM processing your personal data.
(f)In cases where your personal data is processed based on your consent or on a contract and any other grounds are not applicable and where the processing is carried out by automated means, the right to receive the personal data in a structured, commonly used, and machine-readable form and/or to request that SMM transfer such personal data directly to a recipient to the extent technically feasible. Please note that this right is only permitted for personal data which you have provided to SMM yourself.
(g)The right to withdraw your consent to the processing of your personal data at any time. Please note, however, that SMM may continue to process your personal data if it is able to rely on another legal basis.
